THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10854 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.4 in Crime.No.834 of 2023 on the file of Raidurgam Police Station, Cyberabad Commissionerate, registered for the offences under Section 21 (b) and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

On 08.10.2023, the Raidurgam Police on receiving information reached the location and apprehended this petitioner along with others. Upon search, they found this petitioner in possession of 3 gms of cocaine, who admitted that he has purchased the same for his personal consumption. 4.

Learned counsel for the petitioner submits that the contraband seized is less than the commercial quantity and the petitioner is not involved in any other crime previously.

On instructions, learned Assistant Public Prosecutor would submit there are no other cases pending against this petitioner. 6.

Since the contraband seized is intermediary quantity and there are no other cases pending against this petitioner, the relief of regular bail can be granted, subject to following conditions:- i) The petitioner/Accused No.4 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of XIII Additional Metropolitan Magistrate, Cyberabad at Rajendranagar, Ranga Reddy District. ii) The petitioner/Accused No.4 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of two weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 7.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
