HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.36271 OF 2021 ORDER (ORAL):

Heard Sri S. Viplav Simha Reddy, learned counsel for the petitioners, and learned Assistant Government Pleader for Home, and perused the material on record.

2. It is submitted by the learned Assistant Government Pleader for Home, based on written instructions, that one Mr. G. Ganesh has lodged a complaint in respect of the subject properties. In pursuance of the said complaint, the police called the petitioners to the police station for the purpose of enquiry. Since the enquiry revealed that the dispute between the petitioners and respondent Nos.6 and 7 as well as the complainant Mr. G. Ganesh is civil in nature, the police suggested all of them to approach the competent Court. However, instead of approaching the competent Court, the petitioners have filed this writ petition with false and baseless grounds. It is further submitted that at no point of time, the police had interfered with the civil disputes between the petitioners and respondent Nos.6 and 7 or threatened the petitioners to handover possession of the disputed property.

Recording the aforesaid submissions of the learned Assistant Government Pleader for Home, the writ petition is disposed of, at the stage of admission itself, directing respondent Nos.4 and 5 not to interfere with the civil dispute between the petitioners and respondent Nos.6 and 7 in connection with house property bearing No.13-2-16/4,

Plot No.36 having plinth area of 45 square feet of shops in ground floor, 464 square feet of residential area in ground floor and 893 square feet in first floor, total plinth area of 1402 square feet (including balconies and common areas) along with undivided share of land admeasuring 55 square yards out of 260 square yards in Surey Nos.113, 114 and 115; and the house property bearing No.13-2-16/4, Plot No.36 having plinth area of 424 square feet in ground floor, 229 square feet in first floor and 772 square feet in second floor, total plinth area of 1425 square feet (including balconies and common areas) along with undivided share of land admeasuring 55 square yards out of 260 square yards in Survey Nos.113, 114 and 115 situated at Satyanarayanapuram, Gaddiannaram Village, Saroornagar Revenue Nagar, Prabhat Nagar, Chaithanyapuri, Ranga Reddy District. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
