HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7951 of 2018 ORDER :

Heard, before admission and before notice to respondent Nos.2 and 3, learned counsel for the petitioner and learned Public Prosecutor, representing the State-1st respondent.

In view of the statutory right of appeal under Section 29 of the Domestic Violence Act to impugn the interim order of the learned Additional Judicial Magistrate of First Class, Siddipet, in Crl.M.P.No.5033 of 2016 in the pending D.V.C.No.8 of 2016, dated 16.03.2017, the petition under Section 482 Cr.P.C. no way survives to go to the merits.

Accordingly, the criminal petition is disposed of, directing the Registry to return the original papers and the lower appellate Court is directed to entertain the appeal if filed within one week from the date of receipt of a copy of this order without reference to limitation, by virtue of this order.
