THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8396 of 2016

ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/revision petitioner, aggrieved by the order dated 06.04.2016 in Crl.R.P.No.61 of 2015, wherein the learned Judge confirmed the orders of the Judicial First Class Magistrate Special Mobile Court, Machilipatnam passed in M.C.No.5 of 2013 dated 29.07.2015.

2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor representing the State.

3. Respondents 1 and 2 herein, who are wife and son of the petitioner herein filed M.C.No.5 of 2013 to grant maintenance of Rs.5,000/- per month. The learned Judicial First Class Magistrate Special Mobile Court, Machilipatnam, vide his order dated 29.07.2015 granted maintenance of Rs.2,000/- each to respondents 1 and 2. Aggrieved by the same, the petitioner preferred revision in Crl.R.P.No.61 of 2015 before the I Additional Sessions Judge, Krishna at Machilipatnam and the learned Sessions Judge dismissed the same vide his order dated 06.04.2016. Hence, this Criminal Petition is filed.

4. Granting of maintenance at the rate of Rs.2000/- p.m. each to respondents 1 and 2 is no way excessive and exorbitant and the learned Magistrate has rightly granted a reasonable amount of maintenance, which is confirmed by the lower appellate Court. Hence, I see no grounds to interfere with the impugned order.

5.

In that view of the matter, the Criminal Petition is dismissed.

6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
