HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.32038 of 2017 ORDER:

It is a case where petitioner - School was directed to be shifted to a different premises considering the fact that the building, under which school is being run, is constructed in violation of the municipal rules. Though learned counsel for the petitioner prays for a direction to the respondents not to interfere with the running of school unless the application filed by the petitioner under Building Regularization Scheme seeking regularization of the unauthorized construction is disposed of, this Court is not inclined to pass such orders especially considering the safety of children who are studying in the school being paramount.

In the circumstances, without expressing any opinion on the merits of the case, the Writ Petition is disposed of with a direction to respondents to consider the representation of the petitioner - School and, subject to feasibility, may grant a month or two to enable the petitioner - School to shift the subject premises.
