HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7302 of 2011 ORDER:
This writ petition was filed challenging the proceedings dated 15.03.2011 issued by the 2nd respondent revoking the orders of suspension and reinstating the 4th respondent as Fair Price Shop dealer of Shop No.34 of Ammapuram village, Thorrur Mandal, Warangal District.

It appears that against the 4th respondent, the proceedings under Section 6-A of the Essential Commodities Act were initiated and the Joint Collector ordered for forfeiture of 70% value of the seized stock. Thereafter, an order of cancellation of authorization of fair price shop dealership of the 4th respondent was passed by the Revenue Divisional Officer, Mahabubabad, 2nd respondent, on 05.08.2010. In spite of the same, when an order of reinstatement of the 4th respondent was passed by the 2nd respondent on 15.03.2011, one of the card-holders filed the present writ petition challenging the said order. When a vacate stay petition was filed in the present writ petition, this Court by order dated 26.03.2012 declined to vacate the interim order dated 22.03.2011 suspending the proceedings of the 2nd respondent dated 15.03.2011.
As a result of which, the 4th respondent was not continuing as a dealer of the Fair Price Shop. It appears that the 4th respondent has not taken any steps challenging the order of cancellation of his authorization.
Divisional Officer and he was reinstated by proceedings dated 19.09.2016. The present petitioner challenged the said proceedings in Writ Petition No.35284 of 2016 and this Court granted interim suspension of the order of reinstatement.

In view of the subsequent developments, no further orders are necessary in the present writ petition as the present writ petition is directed against the order of reinstatement dated 15.03.2011 and it is superceded by another order dated 19.09.2016, which is challenged in W.P.No.35284 of 2016.
