Heard the learned counsel for the petitioner and learned G.P.for Prohibition & Excise.
Grievance of the petitioner is that his request for considering the remission of the license fee with respect to A4 shop granted to him under lease at Ravulapalem village and Mandal, East Godavari District is not being considered. Petitioner states that he is a licencee for the year 2014-15 and his license is valid from 01.07.2014 to 30.06.2015. Petitioner states that after opening of shop, the local villagers prevented him from carrying on business and petitioner therefore reported the matter to the Superintendent of Police, Prohibition & Excise Police Station, Kothapet and made representation in writing. The Superintendent of Police, Kothapet ultimately resolved the issue only on 10.11.2014 and thereafter petitioner has been carrying on business. But in the process he states that he has lost about 130 days, therefore seeks remission.
This writ petition is initially filed after filing an application seeking remission to the Superintendent of Prohibition & Excise, Amalapuram. However, during hearing on 20.02.2015 it was noticed by this Court that no application was filed by the petitioner before Commissioner. Hence, he was granted liberty to make appropriate application. Learned counsel for the petitioner has now filed application to implead the Commissioner and he states that he has filed a representation before the Commissioner on 24.02.2015. Hence, the implead petition is ordered. Since the
petitioner's only grievance is consideration of his application made to the Commissioner as stated above, I deem it appropriate to dispose of the writ petition by directing the Commissioner to consider the petitioner's request.
Accordingly, the writ petition is disposed of directing the Commissioner to consider the petitioner's request and pass appropriate orders expeditiously. No costs.
