HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.12574 of 2024 ORDER :
Petitioner/accused No.1 has filed this petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS, 2023'), seeking bail in Crime No.736 of 2024 of Film Nagar Police Station, Hyderabad, registered for the offence punishable under Section 80 of Bharatiya Nyaya Sanhita, 2023.

Heard Sri Baglekar Akash Kumar, learned counsel for the petitioner and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the State and perused the record. 3.
Case of the prosecution is that petitioner/accused No.1, along with other accused harassed the complainant's daughter, demanding additional dowry, due to which, she committed suicide.

Learned counsel for petitioner submits that the petitioner/accused No.1 is innocent of the alleged offence and
there is no specific allegation with regard to demand of additional dowry and ingredients of Section 80 of BNS, 2023 is not made out. He further submits that most of the investigation in the case is completed, except filing of charge sheet and the petitioner/accused No.1 is in jail since 04.09.2024, and hence, prayed for grant of bail.

Though learned Additional Public Prosecutor opposed the bail stating that specific allegations are leveled against the petitioner/accused No.1, since 21 witnesses have been examined, major part of the investigation is completed and as petitioner/accused No.1 is in jail since 04.09.2024, this Court is of the considered view that it is a fit case for grant of bail subject to following conditions:
i. The petitioner/accused No.1 shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the XVII Additional Chief Judicial Magistrate, Nampally, Hyderabad.
ii. The petitioner/accused No.1 shall appear before the concerned Station House Officer on every Saturday between 11.00 A.M. and 01.00 PM for a period of eight (08) weeks or till filing of charge sheet, whichever is earlier.
iii. The petitioner/accused No.1 shall abide by the conditions stipulated in Section 480(3) of BNSS, 2023.
Petition is accordingly allowed.
