THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No. 19999 OF 2017 ORDER:
This writ petition is filed by the petitioners seeking to direct the respondents not to interfere with their peaceful possession and enjoyment over the property admeasuring Ac.0.94 1⁄2 cents, comprising of Ac.0.441⁄2 cents and Ac.0.50 cents, in Survey No.327/5 of Rajahmundry Municipal Corporation (the then Pidimgoyaa Gram Panchayat).
It is the case of the petitioners that they have purchased the aforestated property under two registered sale deeds bearing Nos.4338 and 4367 dated 31.03.1995 and since then, they are in possession and enjoyment of the same. While so, in the first week of May, 2017, the respondent officials inspected the above property and tried to interfere with the same, without following the due process of law.
Heard and perused the material available on record. The main grievance of the petitioners is that the respondents are trying to interfere with the subject property without following the due process of law.
Considering the circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed to follow the due process of law, if they intend to acquire the property of the petitioners."
With the above direction, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed.
