HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.1500 OF 2014 ORDER:

When the matter is taken up for hearing, Sri C.Rajashekar Reddy, counsel for the petitioner, had contended that the present writ petition is filed challenging the action of the respondents in not considering the case of the petitioner for promotion to the post of Typist/Junior Assistant/Computer Operator with the new pay scales and the petitioner has submitted a representation to the respondents on 30.08.2013. Counsel for the petitioner further contended that since the right to be considered is a fundamental right, appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for promotion to the post of Typist/Junior Assistant/Computer Operator in accordance with law. Standing Counsel appearing for the respondents had contended that if the petitioner submits a representation afresh, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the submissions of learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a representation afresh staking claim for promotion to the post of Typist/Junior Assistant/Computer operator, within a period of two weeks from the date of receipt of a copy of this order, and upon such a representation being received, the respondents shall consider the same

and pass appropriate orders in accordance with law in another six weeks thereafter.

With the above directions, the writ petition is disposed of. No order as to costs.
