HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11819 OF 2010 ORDER:
This petition is filed for a writ of Certiorari declaring the action of the respondents in issuing the auction notice dated 19.05.2010, to hold auction on 28.05.2010 for granting lease hold rights for a period of three years from 2010 to 2013, even though the petitioners' lease hold rights for a period of three years from 2009 to 2012 are subsisting, as illegal and arbitrary and for a consequential direction to the respondents to stay all further proceedings including auction scheduled to be held on 28.05.2010 in respect of the lands of the petitioners.
This Court on 26.05.2010, while admitting the writ petition granted interim suspension of the impugned auction notification dated 19.05.2010 subject to the petitioners depositing the lease amount within a period of four weeks. Now, by virtue of the interim order dated 26.05.2010 passed by this court in WP.MP.No.14930 of 2010, the grievance of the petitioners has been redressed and the petitioners' lease period was also expired. As such, the cause in the writ petition does not survive for adjudication. Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
As a sequel thereto, miscellaneous petitions if any pending in the writ petition shall stand closed.
