HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.26573 OF 2015 ORDER:
This Writ Petition is filed by the petitioner seeking to issue a writ of mandamus to declare the action of the respondents in proposing to lay road in his land admeasuring 230.55 square yards situated in Sy.Nos.651/B, C, Jammikunta village and Nagara Panchayat, Jammikunta Mandal, Karimnagar District, as illegal and arbitrary and consequently direct the respondents not to lay the road in petitioner's land without due process of law.
The case of the petitioner is that he is the owner of an extent of 230.55 square yards situated at Jammikunta Village and Nagara Panchayat, Jammikunta Mandal, Karimnagar District.
The respondents are trying to lay road from the petitioner's land without acquiring the same. Petitioner objected for laying the road through his land by showing his documents in respect of the said land. He also made an application for building permission on 05.01.2015 to the 2nd respondent and the same is pending. Aggrieved by the action of the respondents in trying to lay road in the petitioner's property without following due process of law, this writ petition is filed. Heard learned counsel for the petitioner and the learned counsel for the respondents.
Sri N. Praveen Kumar, learned Standing Counsel for the 2nd respondent, on instructions, submitted that there is no proposal to lay road from the petitioner's land and with an apprehension only, the petitioner filed the present writ petition.
Recording the said submission of the learned Standing Counsel for the 2nd respondent, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending
in this writ petition shall stand closed.
