This criminal petition is filed under Section 438 Cr.P.C. by the petitioner/ A2, seeking release in the event of his arrest in connection with Crime No.108 of 2018 on the file of Bhattiprole Police Station, Guntur District, registered for the offences punishable under Sections 363 r/ w 511 r/ w 34 I.P.C. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor representing the State.

As the very offence is bailable offence, the application under Section 438 Cr.P.C. for anticipatory bail is not maintainable, thereby, the Criminal Petition is disposed of, giving liberty to the petitioner to surrender before the learned Magistrate concerned and seek for regular bail, for which he is entitled. 4.

Consequently, miscellaneous petitions, if any shall stand closed.
