HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 25698 of 2010 Order:
This Writ Petition was filed challenging the action of the second respondent in not considering the request of the petitioner for transfer fro m SVS Medical College, Mahaboobnagar to Gandhi Medical College, Secunderabad, in pursuance of GO Ms. No.434, Health, Medical and Family Welfare (E1) Department, dated 17.12.2008, GO Ms. No.193, Health, Medical and Family Welfare (E1) Department, dated 09.09.2009 and the regulations of Medical Council of India.
2. This Court, by an order dated 08.10.2010, while issuing notice before admission, directed the respondents not to fill up one seat in Gandhi Medical College, Secunderabad, in the II Year MBBS Course.
3. A counter affidavit is filed by the Director of Medical Education, Hyderabad, stating that the order of this Court was received on 09.10.2010 and the same could not be complied with since the process of allotting of migration seats to the applicant was already completed by 28.09.2010 and there is no existing vacancy as on 02.11.2010.
4. In the circumstances and also in view of lapse of time, nothing survives for adjudication in the Writ Petition and the matter has become infructuous.
5. Accordingly, the Writ Petition is dismissed as infructuous. However, in the circumstances, no costs.
6. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
