THE HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.4837 OF 2011 ORDER:
Heard the counsel for the petitioner at length and taken as heard the counsel for the respondent and perused the material on record. As the revision to be maintained under Article 227 of the Constitution of India is not a matter of course without showing not only the order is perverse and unsustainable but also therefrom prejudice is shown caused and that is once not shown, there are no grounds to entertain the revision, but for to say the maintainability of the revision or its dismissal without expressing any opinion on its merits anything no way prejudice the rights of the plaintiff including maintain a separate suit for partition.
Accordingly and in the result, the revision is dismissed. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this revision shall stand closed.
