JUDGMENT

This application is filed seeking permission to withdraw the first appeal stating that there was settlement between the parties. Learned counsel for the respondents state that he has no objection. Submission recorded.

As the settlement has been arrived at, learned counsel for the appellant is permitted to withdraw the 1st appeal in A.S.No.350 of 2006. Accordingly, the petition is ordered. Consequently, the Appeal is dismissed as withdrawn. Miscellaneous Petitions if any, pending in this Appeal shall stand closed.
