HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1937 OF 2017 ORDER:

This writ petition is filed challenging the inaction of the respondents in disposing of the application bearing No.E1/8491/76, dated 26.09.2003 filed by the petitioners in terms of G.O.Ms.No.455, Revenue (UC.I) Department dated 29.07.2002, seeking regularization of excess land under the provisions of Urban Land (Ceiling & Regulation) Act, 1976, in respect of the house bearing MCH No.8-1-402/44, admeasuring 350 Sq.Yards, situated at Gulshan Colony, Shaikpet, Hyderabad.

Learned Assistant Government Pleader for Revenue submits that petitioner's application was rejected on the ground that petitioner has not produced sale deed. Learned counsel for the petitioner submits that the petitioner made representation dated 05.07.2005 enclosing the copy of the sale deed.

Since it is stated that petitioner has already submitted the copy of the sale deed along with the representation, it is for the respondent authorities to consider the application for regularization submitted by the petitioner.

In view of the above, the writ petition is disposed of directing the respondent authorities to consider the

application of the petitioner dated 26.09.2003 and take action in accordance with law. However, if petitioner has not submitted copy of the sale deed, it is open for them to submit the same. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
