THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3058 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.4, 5, 9 and 10 challenging the order dated 26.2.2016 passed in S.C.No.84 of 2014 by the II Additional Sessions Judge, Kurnool at Adoni, Kurnool District. The petitioners are alleged to have committed the offence punishable under Sections 307, 314, 323, 498-A and 323 r/w 34 IPC. It is stated that the petitioners could not attend before the trial Court on 26.2.2016 and they filed a petition on the same day to dispense with their presence. But the trial Court dismissed the said petition and issued NBWs against them. Hence, the petitioners approached this Court.

Heard and perused the material available on record. Considering the facts and circumstances of the case, the Criminal Petition is disposed of with the following direction: "The petitioners are directed to surrender before the trial Court and move an application to recall NBWs issued against them. On such application being filed, the trial Court is directed to recall NBWs issued against the petitioners on the same day on condition of each of them executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum each to the satisfaction of the trial Court. The petitioners are directed to appear before the trial Court on all hearing dates in the above S.C."
