THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION NO. 1130 of 2015 ORDER:

The petitioner who is working as an Anganwadi Worker at the Integrated Child Development Officer at Lohiya Nagar, Kadapa City, challenges the orders passed on 28.11.2014 terminating her engagement as an Anganwadi Worker.

The petitioner has been provided a fair and reasonable opportunity, in my opinion. The impugned order has clearly disclosed that on three different occasions namely on 16.12.2008, 15.07.2009 and 22.11.2011, she was put on notice that she has not been rendering services properly and she has been abstaining from the services without obtaining prior permission. It is now alleged that, though she has assured that she would render services properly, once again she was abstaining from services. Hence, her services have been terminated. However, the learned counsel for the petitioner would point out that an appeal has been preferred by the petitioner against the said orders to the District Collector on 27.12.2014 and since the same has not been disposed of so far, the present writ petition is instituted.

Hardly, a month's time has elapsed since the petitioner has submitted her appeal to the District Collector. Therefore, there is no cause of action for the writ petitioner to have approached this Court as of now.

Be that as it may. I am confident that the District Collector will attend to the appeal said to have been preferred by the petitioner, as expeditiously as time and other pressing engagement appointments would permit him to do so.

With this, the writ petition stands dismissed at the admission stage.

Consequently, the miscellaneous applications pending shall also stand dismissed. No costs.
