Heard the learned counsel for the petitioners and the learned Public Prosecutor for the respondent.
2. The present Criminal Petition under Sections 437 and 439 of Cr.P.C., is filed by the petitioners/accused Nos.5 & 6 seeking to enlarge them on bail in Crime No.187 of 2015 of Madanapalle Taluk Police Station, Madanapalle, Chittoor District, registered for the offences punishable under Sections 353, 307, 379, 109 IPC read with Section 34 IPC and Section 20 (1) (c), (III), (IV) & (IX) of the A.P. Forest Act, 1967, and Rule 3 of the A.P. Sandal Wood and Red Sanders Transit Rules.

The case of the prosecution is as under: On 14.11.2015 at about 2.00 p.m., near Vempalle Cross Road, on Madanapalle-Bangalore main road, the Sub-Inspector of Police along with his staff while conducting vehicle check, tried to stop one Boleri luggage vehicle bearing No.KA 34A 1981, but the driver of the vehicle did not stop and drove the same with high speed, but the police chased them and seized 8 red sandal logs and one Bolero pickup goods vehicle. Basing on these allegations, the above report came to be lodged.
4. Learned counsel for the petitioners submit that on 18.12.2015, A-4 and A-6 were arrested and produced before the II Additional Judicial First Class Magistrate, Madanapalle, and till date, the charge sheet is not filed.
5. Having regard to the above, if the police have not filed charge sheet within the period stipulated under the statute, the petitioners, if so advised, are at liberty to move an application before the trial Court seeking bail and the same shall be dealt with, in accordance with law, at the earliest.
6. With the above direction, the Criminal Petition is disposed of.
