THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 29563 of 2013 O R D E R:

The petitioner prays for mandamus declaring the action of 3rd and 4th respondents in not initiating action against the 5th Respondent pursuant to the complaints dt. 25.09.2013 and 27.09.2013, as illegal and arbitrary and contrary to Sections 139 and 140 of Andhra Pradesh Panchayat Raj Act, 1994.

The Assistant Government Pleader (Home), basing on written instructions dated 19.10.2013, submits that on receipt of complaint an entry in General Diary was made, preliminary enquiry into the allegations was carried out, in which it was transpired that a civil dispute is converted into a complaint and filed before the 4th Respondent. He further submits that the same was informed to petitioner as well.

Sri S.Subba Reddy, counsel for petitioner submits that he does not have latest instructions in the matter.

In view of the written instructions dated 19.10.2013, I am satisfied that the grievance of inaction stated against the 4th Respondent does not survive. Therefore, the writ petition is dismissed accordingly. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
