THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8874 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.304 of 2022 pending on the file of Station House Officer, Shamirpet Police Station, Cyberabad registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(C) and 29 of Narcotic Drugs & Psychotropic Substance (NDPS) Act. 2.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that he was found in possession of two kgs four grams of ganja by Shamirpet Police on 19.08.2022. On the same day the petitioner was apprehended and after following the procedure under NDPS Act, the samples were sent for FSL report and he was remanded to judicial custody.

On instructions learned Assistant Public Prosecutor would submit that there are no other cases pending against this petitioner. 5.

Keeping in view that the quantity being a little above small quantity and that there are no criminal antecedents against this petitioner, he can be granted the relief of regular bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused is directed to be released on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum (among which one local and one native surety) to the satisfaction of I Additional District and Sessions Judge-cumMetropolitan Sessions Judge, Cyberabad at Medchal-Malkajgiri District.

ii) After release on bail, the petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.00 A.M to 1.00 P.M, for a period of twelve (12) weeks or until filing of charge sheet, whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
