The Court made the following:

ORDER:

This Writ Petition is filed for the following substantive relief :

" ... to issue writ or direction preferably writ of mandamus declaring the action of the respondent Nos.2 and 3 in not allotting the kerosene quota in respect of Rachcha banda new cards in favour of fair price shop dealers and allotting in favour of conventional dealers by applying 65% : 35% as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents to continue the allotment of kerosene quota in respect of new cards of Rachcha banda to the fair price shops ..."

At the hearing, Mr. G. Ratna Kumar, learned Counsel representing Mr. Kowturu Vinaya Kumar, learned Counsel for the petitioners, submitted that the cause in the Writ Petition does not survive for adjudication. The Writ Petition is accordingly dismissed as infructuous.

As a sequel to the dismissal of the Writ Petition, WPMP No.43047 of 2011 is dismissed as infructuous. ________________________
