THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42486 OF 2015 ORDER:

The petitioner is aggrieved by Pattadar Pass book and title deed said to have been granted in favour of 5th respondent with regard to the land claimed by the petitioner.

2. The Petitioner has already filed a representation on 18.04.2015 before the Joint Collector, SPSR Nellore District and has also filed a representation before the District Collector, SPSR Nellore, on which, the District Collector directed the Revenue Divisional Officer under letter dated 25.04.2015 marked as Ex.P3 to examine the petitioner's representation and take necessary action. Alleging the inaction on the part of 3rd respondent, the present writ petition is filed.

3. If the petitioner is aggrieved by the grant of pattadar passbook in favour of 5th respondent, she has to prefer an appeal or revision under the A.P.Rights in Land and Pattadar Pass Books Act, 1971, whichever is maintainable. But the petitioner has straightaway approached this Court without availing such statutory remedy of appeal or revision.

4. Hence, with a liberty to the petitioner to take appropriate action, if she is so aggrieved, the Writ Petition is accordingly disposed of. There shall be no order as to costs.
