THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8995 OF 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit it is prayed that this Honourable Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of MANDAMAUS declaring the action of the respondents 2 to 4 in trying of prevent the petitioner from performing the Annual Urs Ceremonies which are schedule to be held between 24-32016 to 26-3-2016 having received the representation dated 8-3-2016 pending enquiry in respect of Dargah Hzt Haji Vali (RH) situated in Sy Nos 682, 674, and 685 of Tallaricheruvu Village, Tadipatri Mandal Anantapur District as being Illegal, Arbitrary, Capricious, Malafide, Contrary to Section 64 (2) of Wakf Act of 1995 and pass such other order or orders as this Honourable Court may deem think fit and proper in the circumstances of the case."
Sri Arifullah, learned Standing Counsel for the Wakf Board, placed before this Court a copy of the proceedings dated 14.03.2016 passed by the Chief Executive Officer of the A.P. State Wakf Board rejecting the application of the petitioner and constituting an Urs Committee for the Urs to be held from 24.03.2016 to 26.03.2016. A copy of the said proceedings is also furnished to the learned counsel for the petitioner.
In the light of the afore-stated development, the cause in this writ petition no longer survives for consideration. The writ petition is accordingly dismissed leaving it open to the petitioner to workout his grievances, if any, as regards this subsequent development in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
