THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.10895 & 10896 OF 2023 COMMON ORDER:

These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.3, 4 and 5 respectively in Crime.No.318 of 2023 on the file of Korutla Police Station, Jagtial District, registered for the offences under Sections 302, 380, 201 and 120-B r/w. 34 of IPC.

Since the petitioners in both the petitions are accused Nos.3, 4 and 5 respectively in the very same crime, both the petitions are heard together and disposed off by this common order.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that A-1 and A-2 are acquainted with each other and they were in love. The deceased and A-1 were staying in the same premises. A-2

went to the house of A-1 and A-1 wanted to go outside with A-2. The deceased resisted and asked her not to go out. A1 has took out a scarf and tightened it around the neck of the deceased and committed murder. A-2 allegedly held the hands and legs of the deceased. Gold and cash of the deceased was taken.

After committing murder, A-2 informed about the commission of murder to these petitioners. These petitioners allegedly helped A-1 and A-2 in their escape to Maharashtra.

Admittedly, the knowledge of alleged commission of murder is not known to these petitioners. However, it is stated that after committing murder, A-2 has informed the same to these petitioners.

Since the alleged acts of these petitioners would amount to causing disappearance of evidence, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioners/Accused Nos.3, 4 and 5 shall execute personal bond for a sum of Rs.25,000/-

(Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of Principal District and Sessions Judge, at Jagtial. ii) The petitioner/Accused No.5 after release shall appear before the concerned Station House Officer everyday at 10:00 a.m. for a period of eight weeks and thereafter, as and when required. As far as petitioners/A-3 and A-4 are concerned, they shall appear on every Monday at 10:00 a.m. for a period of four weeks and thereafter, as and when required. iii) The petitioners/Accused Nos.3, 4 and 5 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, these Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
