THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8884 OF 2022 O R D E R:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.2 and 3 in Crime No.78 of 2022 pending on the file of Station House Officer, Kubeer Police Station, Nirmal District registered for the offences punishable under Sections 306 and 498-A of Indian Penal Code.

Heard learned counsel for the petitioners/Accused Nos.2 and 3 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

According to the complaint, the petitioners daughter-in-law committed suicide for the reason of Accused No.1 who is the husband and these petitioners who are parents-in-law and five others were harassing the deceased. Specifically the father of the deceased lodged a complaint stating that Accused No.1 was habituated to bad habits and had illicit relations with other women. The deceased was treated as a servant and unable to bear the harassment, she committed suicide by consuming pesticide.

As seen from the complaint, except making bald allegations that these petitioners treated the deceased as a servant, there are no specific allegations attributed to these petitioners who are the parents-in-law. The petitioners are aged about 65 and 68 years respectively.

Keeping in view the bald allegations leveled against these petitioners and the age of the petitioners, they can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 and 3 are granted bail subject to the following conditions:
i) The petitioners/Accused Nos.2 and 3 are directed to be released on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of Judicial Magistrate of Class at Bhainsa.
ii) After release on bail, the petitioners/Accused Nos.2 and 3 shall appear before the investigating authorities as and when required for the purpose of investigation.
iii) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 13.10.2022 ns/rev
