Kummari Kumar v. The State Of Telangana

THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37513 of 2016 ORDER:

Petitioner complains against seizing Goods Carriage bearing No. TS 07 UA 3366 as illegal and unconstitutional and seeks release of the vehicle in terms of G.O.Ms.No.3 Industries & Commerce (Mines-I) Department, dated 08.01.2015, and G.O.Ms.No.15 Industries and Commerce (Mines-I) Department, dated 19.02.2015. The Assistant Government Pleader submits that the vehicle is being produced before the concerned Magistrate and application is required to be made for release of the vehicle. The petitioner is given liberty to move the compete Court for release of vehicle and he is also given liberty to specifically draw the attention of the learned Magistrate to the procedure stipulated in G.O.Ms.No.15, dated 19.02.2015, and by satisfying that the subject vehicle is involved for the first time, obtain appropriate orders. As and when such application is made, it is hope, expeditious orders are passed not latter than one week therefrom. Writ petition is accordingly disposed of.
