HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.140 of 2016 ORDER:

This petition is filed to withdraw H.M.O.P.No.4 of 2016 from the file of Additional Senior Civil Judge, Narasaraopet, Guntur District and transfer the same to Senior Civil Judge, Nandigama, Krishna District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 14.08.2009 at Kanaka Durga Temple, Vijayawada and since respondent is working in Army, petitioner stayed with respondent at his work place and joined him in a quarter provided by the Army in Jammu and Kashmir and thereafter due to disputes came to her parents house and made a complaint in Nandigama Police Station, which is registered as Crime No.384 of 2015 for the offence under Section 498-A read with 34 IPC and respondent filed intentionally HMOP No.4 of 2016 for dissolution of marriage to harass her. She further stated that all the witnesses are residents of Nandigama and no cause of action did take place at Narasaraopet and O.P. is filed only to harass petitioner to make her travel from Nandigama to Narasaraopet. For these reasons, she prayed for transfer of HMOP No.4 of 2016 from Senior Civil Judge, Narasaraopet to Senior Civil Judge, Nandigama, Krishna District.

3. On 03.03.2016, this Court permitted petitioner to take out personal notice to respondent through registered post with acknowledgement due and file proof of service. In compliance of the said order, advocate for petitioner filed a Memo on 29.03.2016 stating that notice sent to respondent was served on him and

postal acknowledgment with postal receipt is filed to that effect. Respondent in spite of service of notice neither appeared in person nor through any advocate.

Considering the reasons stated in the affidavit and also considering the convenience of wife, H.M.O.P.No.4 of 2016 is withdrawn from the file of Additional Senior Civil Judge, Narasaraopet, Guntur District and transferred to Senior Civil Judge, Nandigama, Krishna District for disposal in accordance with law.

5. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 31-03-2016 gvl
