HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 45177 of 2016 Order:
The petitioner states that the vehicle bearing registration No.AP07W-5225 is a contract carriage vehicle and covered by district contract permit valid up to 06.11.2021. The permit is valid for plying in the district of Wanaparthy. Whenever there is a need for plying beyond Wanaparthy district, a special permit has to be obtained. The vehicle was engaged for plying from Alampur to Pumba and other places to visit Ayyappa Temple and returning. The vehicle was given for hire. The petitioner obtained a special permit valid from 14.12.2016 to 20.12.2016. While the vehicle was returning from Pumba on 20.12.2016 it was parked in Balaji bus stand, Tirupathi and the petitioner was making effort for extension of the permit. While so, the third respondent inspected the vehicle which was parked and seized the same by issuing check report on 21.12.
2016. Now, the petitioner states that he obtained another special permit valid from 21.12.2016 to 29.12.2016 and he is ready to pay the tax of Rs.12,600/- as per G.O.Ms.No.140 dated 12.08.2002. When the petitioner approached the second respondent on 21.12.2016 for release of the vehicle the same was refused. In those circumstances, the petitioner approached this Court.
Since the petitioner obtained another special permit valid from 21.12.2016 to 29.12.2016 and he is willing to pay the compounding fee along with tax due to a tune of Rs.12,600/-, the vehicle shall be released on payment of the said amount of Rs.12,600/- (Rupees Twelve Thousand Six Hundred only) along with the compounding fee.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
