THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.13640 of 2014 ORDER:

Sri Manu, learned counsel for the petitioner, is present. Even learned counsel for respondent No.2 is also present. Learned Additional Public Prosecutor for the State of Telangana on behalf of respondent No.1 would represent that the police filed a report on 19.04.2016 before the concerned Magistrate referring the case as " Undetected" .

Learned counsel for respondent No.2 would represent that a direction be given to the police as to the shifting of residence of respondent No.2-defacto complainant from the house in which she was residing on the date of lodging the complaint to the other house in which she is now residing, so as to conduct further investigation. The direction sought by learned counsel for respondent No.2 is beyond the purview of this Court. For investigation, there is procedure contemplated under the provisions of the Code of Criminal Procedure and, as and when notice is received, respondent No.2 - defacto complainant is at liberty to file a protest petition making similar request before the learned Magistrate. Even if notice is not received, since learned counsel for respondent No.2 has now gained knowledge, it is open to respondent No.2 to approach the learned Magistrate and make a similar request. Accordingly, the Criminal Petition is disposed of at the stage of admission itself.

Miscellaneous applications, if any pending in the present petition, stand closed.
