HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30210 OF 2016 ORDER:

Learned counsel for the petitioner says that the respondent-municipal authorities are insisting for "No Objection Certificate" (NOC) for consideration of building permission of the petitioner dated 12-04-2015 in respect of 370.04 square meters out of 627 square meters regarding premises bearing No.8-2-293/174/A/28. Aggrieved by the same, the present writ petition is filed.

Learned Standing Counsel for the Municipal Corporation states that the respondent-Corporation is not insisting for any NOC from the petitioner. This Court in Hyderabad Potteries Private Limited v.

Collector, Hyderabad district in W.P.No.25727 of 2000 also held that the municipal authorities cannot insist for NOC for the purpose of considering building permission.

In view of the same, the respondents 4 and 5 are directed to consider the application of the petitioner, dated 12-04-2015, for building permission in accordance with law without insisting NOC.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
