THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 8885 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused in the event of his arrest in connection with Crime No.95 of 2022 on the file of Station House Officer, Panjagutta Police Station, Hyderabad registered for the offences punishable under Sections 354-D and 509 of Indian Penal Code, Section 11 read with Section 12 of POCSO Act and Section 67 of IT Act.

Heard the learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Learned counsel for the petitioner submits that the petitioner and the de facto complainant are classmates. During their schooling they used to exchange messages and at that juncture the family members of the de facto complainant objected for the same, as such at the instance of her parents she filed a complaint. He further

submits that the petitioner is a student and there are no criminal cases pending against this petitioner. He also submits that the petitioner has falsely implicated as accused in this case. 4.

On instructions learned Assistant Public Prosecutor would submit that no criminal cases are pending against this petitioner. 5.

In the said circumstances, the petitioner/Accused who is a student can be granted the relief of Anticipatory Bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted anticipatory bail subject to the following conditions:

i) The petitioner/Accused is directed to surrender before the Station House Officer, Panjagutta Police Station, Hyderabad within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioner/Accused shall appear before the Station House Officer, Panjagutta Police Station, everyday at 09.00 AM for a period

of three (03) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
