This Criminal Revision Case is filed by the petitioner - accused to set aside the judgment dated 18.01.2017 in Crl.A.No.1096 of 2015 passed by the III Additional Metropolitan Sessions Judge, Rangareddy District confirming the judgment of conviction and sentence imposed in C.C.No.140 of 2015 dated 09.11.2015 on the file of the I Special Magistrate Court, Malkajgiri, Ranga Reddy District.

During the pendency of the present revision case, the petitioner-accused filed I.A.Nos.1 and 2 of 2022 seeking permission to compound the offence with the complainant and to compromise the matter by recording the terms of compromise and to quash the proceedings against him in the said case, since they had settled the matter out of court.
3. Today, the complainant and the accused appeared before this Court. They filed copies of their Aadhar Cards in proof of their identity and they are also identified by their respective counsel on
record. The parties have also filed a Memorandum of Compromise along with a Joint Memo. The complainant stated that he intended to compromise the matter for an amount of Rs.5,00,000/- (Rupees Five Lakhs only) in lieu of the cheque amount and he had already received Rs.1,00,000/- (Rupees One Lakh only) at the time of filing this revision case and he received Rs.4,00,000/- (Rupees Four Lakhs only) in cash today before this Court from the petitioner - accused on the intervention of the elders and well wishers.

As such, I.A. Nos.1 and 2 of 2021 are allowed recording the compromise between the parties and compounding fee is waived for the reasons stated by the petitioner in his affidavit. Consequently, Crl.R.C.No.1355 of 2017 is allowed setting aside the judgment dated 18.01.2017 in Crl.A.No.1096 of 2015 passed by the III Additional Metropolitan Sessions Judge, Rangareddy District, wherein the appellate Court confirmed the judgment of conviction and sentence imposed against the petitioner-accused in C.C.No.140 of 2015 dated 09.11.2015 on the file of the I Special Magistrate Court, Malkajgiri, Rangareddy District.

The petitioner-accused is acquitted for the offence under Section 138 of the Negotiable Instruments Act. The bail bonds of the accused shall stand cancelled.

Parties are directed to pay an amount of Rs.10,000/- (Rupees Ten Thousand only) to the High Court Legal Services Committee, Hyderabad within one week from the date of this order.
