THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8889 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C."), seeking to enlarge the petitioner/accused No.11 on bail in connection with Crime No.328 of 2022 of Chaderghat Police Station, Hyderabad District, registered for the offences punishable under Sections 8(c) read with Section 22(c), 27 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "N.D.P.S.Act").

Heard learned counsel for the petitioner/accused No.11 and learned Assistant Public Prosecutor for the respondents-State and perused the record.

The case against the petitioner/accused No.11 is that on the basis of the confession of accused Nos.1 and 2, the Police implicated this petitioner and identified him as a person selling drugs in the name of 'Terminator'. However, even according to the Remand Report, there are no seizures affected from this petitioner. This petitioner was granted bail in Criminal Petition No.8879 of 2022. 4.

Since the petitioner is a student and there is no mention of contraband seized from this petitioner, which is either small quantity

or commercial quantity, he can be granted the relief of regular bail. Therefore, this Court is inclined to grant the relief of regular bail to the petitioner/accused No.11 on the following conditions: i) The petitioner/accused No.11 is directed to be released on bail on his executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, among them one surety shall be local and one surety shall be native, to the satisfaction of the learned VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

ii) The petitioner/accused No.11 shall appear before the Station House Officer, Chaderghat Police Station, Hyderabad District, on everyday between 09.00 A.M. to 04.00 P.M., for a period of 30 days, thereafter as and when required.

iii) The petitioner/accused No.11 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
