Pulagam Appa Rao v. Sri Katamaneni Bhaskar,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.1641 of 2015 ORDER:
Petitioners' grievance is that the official respondents in collusion with third parties are violating the order dt.07-11-2014 passed in W.P.M.P.No.39836 of 2014 in W.P.No.31869 of 2014, wherein this Court directed maintenance of status quo for 8 weeks. 2.
It is stated by the learned counsel for petitioners that the said order was extended subsequently and at the instigation of the respondents, certain third parties are digging the subject land. In support of the said allegation, photographs have been placed before this Court.
3.
This allegation is denied by the official respondents in the counter-affidavit filed on their behalf.
4.
In the absence of any material field by petitioners to establish that the official respondents have violated the order or at their instigation some private respondents are digging in the subject land, the respondents cannot be punished for Contempt of Court. 5.
Therefore, I see no merit in the Contempt Case and it is accordingly closed. No costs.
6.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
