Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise. 2.

Praying to release Auto Trolley bearing Registration No.TS 01 UB 3345, seized on the allegation of violation of provisions of the Andhra Pradesh Excise Act, petitioner filed an application before the Deputy Commissioner, Prohibition & Excise, Adilabad-2nd respondent, which was received by the office of the 2nd respondent on 19.12.2016. Alleging that the said application is not disposed of and that the vehicle is kept in open area causing damage to the vehicle, this writ petition is filed.

Since the application filed by the petitioner is pending, without expressing any opinion on merits, the writ petition is disposed of directing the 2nd respondent to pass orders on the application submitted by the petitioner, as expeditiously as possible, preferably, within a period of ten days from the date of receipt of copy of this order. It is needless to observe that if the request of the petitioner for interim custody of the vehicle is accepted pending finalization of the proceedings in Crime No.373 of 2016, the 2nd respondent may impose appropriate conditions as required. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
