HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION NO. 1375 OF 2015 ORDER:

At the admission stage, the following order is passed. Having regard to the fact that on the report given by the complainant, who is the mother of the accused, stating that due to family disputes her son, that is, the accused, beat her indiscriminately, the police of Vuyyuru Rural Police Station, Krishna District registered a case in Crime No. 166 of 2014 and laid charge sheet against the accused for the offences under Sections 324 and 509 IPC, it is not a fit case to quash the proceedings. However, liberty is given to the petitioner/accused to file a discharge application, in which case, the trial court shall dispose of the same on merits.

The appearance of petitioner/accused in CC No. 849 of 2014 on the file of IV Additional Metropolitan Magistrate, Vijayawada, is dispensed with except on the occasions when his presence is required by the trial court.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
