THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8893 of 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal procedure, 1973 seeking pre-arrest bail to the petitioner/Accused in the event of his arrest in Crime No.221 of 2022 on the file of Station House Officer, Zaheerabad Town Police Station, Sangareddy District, registered for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.
The facts of the case in brief are that the deceased is a gold smith and he committed suicide for the reason of alleged harassment by the petitioner. The petitioner gave one tula of gold to the deceased for making gold ornament, but the deceased failed to return the gold or the ornament. For the said reason, on 20.08.2022, the petitioner and others went to the house of deceased and tortured him to give him gold ornament or the money. Unable to bear the said incident, the deceased committed suicide by consuming poison.

As seen from the complaint, the petitioner has given his gold for preparing an ornament was pursuing with the deceased. Even assuming that the petitioner had insisted and confronted the deceased regarding the gold that was given will not amount to abetment of committing suicide prima facie. For the said reasons, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of his arrest subject to the following conditions:
i) The petitioner/Accused is directed to surrender before the Station House Officer, Zaheerabad Town Police Station, Sangareddy District within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.
ii) On such release, the petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or until filing of charge sheet whichever is earlier.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
