HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.17015 of 2011 ORDER:

Neither is Sri Madan Mohan Lal, Learned Counsel for the petitioner present nor is there any representation on his behalf. This Writ Petition is filed seeking a writ of mandamus to declare the tender dated 07.06.2011, issued by the first respondent for supply of 500 Brush Cutters, as illegal, arbitrary and in violation of Article 14 of the Constitution of India.

The tender notification was issued on 07.06.2011 for procurement of 500 Brush cutters. The last date for submission of tender, as prescribed therein, was 22.06.2011. The tenders were to be opened on the same day at 4.00 p.m. While admitting the Writ Petition on 09.09.2011, this Court merely ordered notice in WPMP. No.20444 of 2011. As the last date for submission of tender was 22.06.2011 more than six and half years ago, the tender must have been awarded and the work executed. It is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court. The Writ Petition has become infructuous and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. No costs.
