HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12929 of 2012 ORDER:

Heard both sides and perused the record. With the consent of both the parties, the writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not disposing of the representation dated 12.12.2011 made for issuance of residential certificates to 63 fishermen residing at Burepalli, Maddipadu Mandal, Prakasham District, as illegal, arbitrary, contrary to norms of public policy and violative of principles of natural justice; and consequently direct the respondents forthwith to issue residential certificates to 63 fishermen while disposing of their representation dated 12.12.2011.

Learned counsel for the petitioner submits that though the representation was made in the year 2011 till date no orders are passed on the said representation. No counter is filed on behalf of the respondents but the Government Pleader on oral instructions submits that a direction may be given for disposal of the representation, provided the same is still pending. Without going into the merits of the case and having regard to the circumstances stated, the writ petition is disposed of directing the respondents to dispose of the representation dated 12.12.2011, if the same is still pending, in accordance with law, within a period of twelve (12) weeks from the date of receipt a copy of this order. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
