Bonthu Mavullaswamy, v. State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.38720 OF 2013 ORDER:
Heard.
2.
This Writ Petition is filed declaring the action of the respondents in insisting the petitioner to pay EMD for civil contract works notified in 'E' Procurement Short Term Tender Notice dated 07.11.2013 as illegal and arbitrary. 3.
It is contended that as per the Government Orders in G.O.Ms.No.52, dated 18.03.2000, EMD should not be insisted to award contracts for the persons belonging to scheduled castes. 4.
This Court, by order dated 31.12.2013, directed the respondents to consider the petitioner's tender application without insisting for EMD.
5.
Learned counsel for the petitioner informs the Court that pursuant to the interim order, dated 31.12.2013, petitioner's tender application was processed; contract was awarded to him and amounts were also paid.
6.
In view of the subsequent developments, the cause in the Writ Petition does not survive for adjudication and the Writ Petition has become infructuous.
7.
The Writ Petition is accordingly dismissed. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
