HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.349 OF 2017 ORDER:
The present Criminal Petition is filed under Section 482 of Criminal Procedure Code, 1973 (for short, 'the Code') in Crime No.20 of 2016, dated 23.01.2016, of Manuguru Police Station, Khammam District, Telangana State.

The petitioners, who are arraigned as accused Nos.1 & 3 respectively in the aforesaid crime. They alleged to have committed the offence punishable under Section 420 of IPC. 3.
Heard Sri T. Janardhan Rao, the learned counsel for the petitioners / accused Nos.1 & 3, and the learned Additional Public Prosecutor for the State of Telangana.

The learned counsel for the petitioners would submit that in fact the matter was already settled, but, somehow, the de facto complainant has not come forward despite receiving the total amount. 5.
The learned counsel for the petitioners would make a request to direct the Investigating Officer to follow the procedure under Section 41-A of the Code.

The request is reasonable in view of the averments made in the Grounds. Hence, the request is acceded directing the Investigating Agency to issue notice Section 41-A of the Code.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition shall stand closed.
