I.A.No.2 OF 2025 This application is filed praying this Court to grant relaxation to Condition No.iii imposed in the order passed by this Court in Criminal Petition No.12549 of 2024, dated 30.01.2025 and direct the trial Court to return the passport of the petitioner/accused No.5 for a limited period of 24 days i.e. from 23.10.2025 to 15.11.2025.

Learned counsel for the petitioner submitted that the petitioner herein was already granted bail on 30.01.2025, wherein the petitioner herein was directed to surrender his passport to the concerned Court and as per the direction, the petitioner has deposited his passport. It is further submitted that the petitioner requires the passport for travelling abroad to attend a wedding ceremony of a close family friend's son from 23.10.2025 to 15.11.2025. It is further submitted that the petitioner is scrupulously complying with all the conditions imposed by this Court. Hence, he requested to direct the concerned Court to return his passport and also permit the petitioner to travel abroad

for the above said period and the petitioner will deposit the same before the trial Court. Therefore, he prays for relaxation of the said condition.

On the other hand, learned Public Prosecutor opposed the submissions made by the learned counsel for the petitioner by filing the counter affidavit and stated that, if permission is granted, the petitioner will abscond and he will not cooperate with the trial and if any permission is granted, certain condition has to be imposed and after returning from abroad, immediately, the petitioner has to deposit his passport before the trial Court. Therefore, he prayed the Court to dismiss the criminal petition. In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is seeking relaxation for a limited period i.e. from 23.10.2025 to 15.11.2025, as the petitioner herein wants to travel abroad to attend a wedding ceremony of a close family friend's son.

Considering the facts and circumstances of the case, this interlocutory application is allowed granting permission to the petitioner to travel abroad from 23.10.2025 to 15.11.2025 on executing a personal bond of Rs.

abroad, the petitioner has to deposit his passport before the concerned Court on or before 20.11.2025.. All other conditions shall remain unaltered.
