THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.15182 OF 2016 ORDER:

This criminal petition, under Section 482 Cr.P.C., is filed by the petitioner seeking a direction against the II Additional Assistant Sessions Judge, Nandyal, Kurnool District, to pass appropriate order on the application filed by the petitioner undated converting the charges from Section 306 to 304-B IPC making certain allegations, raising several contentions that the death of his daughter was due to subjecting her to cruelty and not suicide.

When the petitioner filed a petition being the de facto complainant, it is for the court to decide the application in according with law and shall not be kept pending ad infinitum. However, taking into consideration of the facts and circumstances of the case, I deem it appropriate to direct the II Additional Assistant Sessions Judge, Nandyala, Kurnool District, to decide the said application and pass appropriate order within 15 days from the date of receipt of a copy of this order.

With the above direction, the criminal petition is allowed. Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
