UMA DEVI Writ Appeal No. 1104 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred by the 5th respondent in the writ petition. Respondent Nos. 1 and 2 herein filed the writ petition seeking a mandamus to declare the action of the Government in issuing G.O.Rt. No. 64 dated 20.4.2017 according permission for change of management of the 5th respondent-society to the 6th respondent-society, and in shifting the degree college from Nagayalanka Mandal to Pamarru Mandal, as arbitrary and illegal.
In the ad-interim order under appeal, the learned Single Judge observed that, if no admissions had commenced as on the date of the order, the respondents shall not implement G.O.Rt. No. 64 dated 20.4.2017.
As the order under appeal is an ad-interim order, the appellant has the remedy of filing a petition seeking vacation of the said order. We see no reason, therefore, to entertain this appeal. Leaving it open to the appellant to file a counter affidavit along with a petition seeking vacation of the interim order, the writ appeal fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
