THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26635 of 2018 ORDER:
Heard Mr.S.S.Bhatt for petitioners and the learned Assistant Government Pleader for Assignment.
The petitioners challenge the proceedings No. Ref:B/140/2018 dated 12.06.2018, as illegal, without jurisdiction and unconstitutional.
The issue arises under the A.P.Assigned Lands (POT) Act, 1977. The petitioners questioning the legality of order dated 12.06.2018 filed appeal and also an interlocutory application for suspending the orders dated 12.06.2018.
The petitioners, it is informed, are satisfied if a direction is issued to appellate authority to take up and pass orders on the interlocutory application expeditiously and in the meantime, the respondents may be restrained from interfering with the possession and enjoyment of petitioners.
The Assistant Government Pleader submits that a direction may be issued to appellate authority/Respondent No.3 to pass orders on the interlocutory application filed by petitioners and he brings to the notice of this Court that two more writ petitions are filed on the same subject, namely,
W.P.Nos.5790 of 2018 and 7789 of 2018 and submits that status quo as regards possession, physical features etc., be maintained till the disposal of the interlocutory application.
The respective submissions are noted and with the consent of the counsel, the writ petition is disposed of by this order:
(a) Respondent No.3/appellate authority is directed to dispose of the interlocutory application within two (02) weeks from the date of receipt of copy of this order.
(b) The parties are directed to maintain status quo in all aspects vis-à-vis possession, physical features etc., for a period of two weeks or till the order is made and communicated in the interlocutory application.
(c) The appellate authority considers disposing of the appeal expeditiously.
No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
