THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12105 of 2025 ORDER:
Seeking the Court to enlarge the petitioners, who arrayed as accused Nos.2 and 4 in Crime No.586 of 2025 of Kushaiguda Police Station, Rachakonda Commissionerate, on bail, the present petition is filed.

The brief facts of the case are that, on 07.08.2025, the defacto complainant lodged a report with the Police stating that the marriage of his daughter was solemnized on 06.02.2025. At the time of marriage, an amount of Rs.5,00,000/- was given to the family of the petitioner, and they further agreed to pay an additional amount of Rs.5,00,000/- after the marriage, as demanded. It is alleged that the petitioner, along with his family members, harassed the deceased, who ultimately led her to commit suicide on 07.08.2025, as such requested the police to take appropriate legal action. Based on the said complaint, the police registered a case vide Crime No.586 of 2025 for offences punishable under Sections 80 and 85 of the Bharatiya Nyaya Sanhita (BNS), and Sections 3 and 4 of the Dowry Prohibition Act, 1961 (DP Act).

Heard Sri K. Rohit, learned counsel appearing for the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 4.
Learned counsel for the petitioners submitted that petitioner No.1 was the father of accused No.1 and petitioner No.2 was the brother of accused No.1 and both petitioners had never resided with accused No.1 and the deceased and even according to the complaint, the marriage was performed in the month of February, and accused No.1 and the deceased had been residing separately since May and that the alleged incident occurred in the month of August, therefore, there was no proximity between the petitioners and the allegations made against them. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that although there were no specific allegations against the petitioners, the marriage of the deceased with accused No.1 was performed in February, and she committed suicide in August, i.e., within six months of the marriage. Hence, he argued that the allegations against the petitioners were of a
serious and heinous nature and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the petitioners are the father and brother of accused No.1, respectively. As seen from the record, the petitioners did not reside with accused No.1 and the deceased. The petitioners have been in judicial custody since 09.08.2025, and a substantial part of the investigation has already been completed. In view of these circumstances, and taking into account the nature of the allegations, the present stage of investigation, and the duration of incarceration, this Court deems it appropriate to grant bail to the petitioners, subject to the following conditions: i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional Junior Civil Judge-cum-II Additional Metropolitan Magistrate, Malkajgiri.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till
filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
