HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY TRANSFER CRIMINAL PETITION No.270 OF 2016 ORDER:

This petition is filed to withdraw Criminal Appeal No.182 of 2012 on the file of XV Additional Sessions Judge, Nandigama and transfer the same to any other court.

The only allegation made in the petition is that as parties to the appeal i.e., first petitioner and second respondent are advocates practicing before XV Additional District and Sessions Judge Court at Nandigama, they are apprehending that there is likelihood of influencing the officer working there.

It is submitted that petitioners filed the petition before the District Court, Machilipatnam in Tr.Crl.M.P.No.255 of 2015 which was dismissed on the ground that it is only an apprehension. However, in view of the objection reported by the counsel for other side, the matter is withdrawn and transferred to Metropolitan Sessions Court, Vijayawada and the Sessions Court is directed to hear and decide the matter in accordance with law. Accordingly, this Criminal Petition is allowed.
