HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 46310 of 2016 ORDER:

1) Heard learned counsel for the petitioner, Government Pleader for Revenue for respondent Nos.1 and 2 and Sri Anchap Panduranga Rao, learned Standing Counsel for respondent No.3. With the consent of all the parties, the main writ petition is being taken up for disposal at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in considering the representations of the petitioner dated 19.10.2009, 11.01.2012, 23.01.2012, 18.04.2016, 12.09.2016, 19.12.2016 and 24.12.2016 as illegal, arbitrary and unconstitutional; and consequently direct respondent Nos.2 and 3 not to undertake any construction activity other than park in block No.9, Road No.3, Sy.No.128/ 6, L.P.No.362/ 82, admeasuring 1400 square yards, Ayodhya Nagar, Kakinada, East Godavari District. 3) Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent Nos.2 and 3 to consider his representation dated 24.12.2016.

4) The Government Pleader for Revenue submits that if the said application is still pending consideration, the authorities may

be directed to consider the said representation in accordance with law.

5) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing respondent Nos.2 and 3 to dispose of the representation dated 24.12.2016, in accordance with law, as expeditiously as possible, preferably within a period of two (02) weeks from the date of receipt of the order, if the same is still pending consideration. No order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
